These Terms of Service (“Terms”) explain the conditions of your service plan (“Plan”) with Real Appliance Repair. By purchasing, renewing, or using the Plan, you agree to be bound by these Terms.
For your convenience, your Plan will automatically renew on each anniversary of your Coverage Date (the “Anniversary Date”) unless:
You notify us before the Anniversary Date that you do not wish to renew, or
We notify you before the Anniversary Date that your Plan will not be renewed.
This Plan is intended for single-family residential properties only, including:
Houses
Townhomes
Condominiums
Apartments
Modular or manufactured homes permanently anchored to a foundation
This Plan does not cover:
Equipment located in commercial properties or properties used primarily for business purposes
Common/shared areas or systems in multi-unit buildings
Multiple units of the same equipment (coverage applies only to the first unit serviced)
We reserve the right to cancel or discontinue your Plan at any time.
Any refund (if applicable) will be provided on a pro-rata basis.
We will complete any service requests that were made prior to cancellation.
If the Plan is cancelled by you or cancelled due to non-compliance (including non-payment), you may be charged for any remaining balance unless stated otherwise in these Terms.
You may cancel your Plan at any time by contacting us (see “Contact Us”).
If you move to a new residence, the following options apply:
Your Plan may be transferred to your new home within our service area.
Any remaining balance will be billed and credited toward your updated Plan.
If you do not transfer your Plan or relocate outside our service area, any remaining balance will be billed.
You must notify us at least 30 days prior to your move to ensure proper processing.
Full refund if no service has been provided.
If service has been provided, your refund will be issued minus the service cost.
If equipment is determined to be ineligible:
If no service was performed: refund up to 12 months of payments
If service was performed: refund up to 12 months of payments from the last service date
We may revise these Terms, conditions, or pricing by providing 30–90 days’ notice prior to the Anniversary Date. Any changes become effective on the Anniversary Date.
Service coverage applies only if the equipment is:
Located within the home’s permanent foundation (excluding outdoor AC units)
Properly installed and operational as of the Coverage Date
Accessible and safe for our technician to service
While we aim to solve issues on the first visit, we are not responsible for delays, misdiagnosis, or circumstances beyond our control. Our obligation is limited to resolving covered service issues.
We are not responsible for:
Consequential or indirect damages
Pre-existing defects
Items under manufacturer warranty
Work performed by unauthorized technicians or third parties
All covered service must be performed only by our authorized technicians.
If parts are unavailable or replacement is not economically feasible:
Either party may terminate the Plan
If applicable, a refund of up to 12 months of payments from the last service date may be issued
All covered repairs are warranted for 90 days after service completion, unless a longer manufacturer warranty applies.
This Plan does not cover:
Commercial-use equipment
Pre-existing conditions
Misuse, abuse, tampering, or improper installation
Fire, flood, earthquakes, extreme weather, vandalism, theft, or other “Acts of God”
Damage caused by pests, mold, rust, corrosion, or hazardous materials (including asbestos)
Code violations or required upgrades
Consumables (filters, fuses, batteries, etc.)
Cosmetic or structural repairs (walls, floors, cabinets, etc.)
Unauthorized repairs or third-party service charges
Items under manufacturer or builder warranty
Preventative maintenance unless specifically stated
We also reserve the right to exclude certain equipment models or types.
We may decline service if we determine conditions are unsafe or unsanitary, or if equipment is inaccessible.
If such conditions exist, we reserve the right to cancel your Plan without refund.
These Terms and this Agreement are governed by the laws of Ontario, Canada.
These Terms represent the complete agreement between you and Real Appliance Repair and replace any prior agreements, conversations, or understandings.
If there is any inconsistency between these Terms and any enrollment or promotional materials, these Terms shall prevail.
We may assign or transfer this Agreement without notice. You may not assign or transfer this Agreement without our written consent.
We may contact you using the phone number or email you provide. You are responsible for keeping your contact details current and accurate.
We are not responsible for delays or failure to perform services due to events beyond our reasonable control, including natural disasters, emergencies, or governmental actions.
